By accessing or using our website emstel.co.za and our services, you agree that you have read, understood, and are bound by these Terms & Conditions and all applicable laws of South Africa.

1. Registration
- You may browse the website without registering, but to place an order you must provide accurate, complete, and up-to-date information.
- If false or misleading information is supplied, any contractual obligation by Emstel Art & Framing will be considered void.
- Customers under the age of 18 must have consent from a parent or legal guardian to place an order.
2. Copyright & Intellectual Property
- All content on this website (including artworks, images, design, logos, text, and graphics) is owned by Emstel Art & Framing , Gallery Direct or its content suppliers and is protected under South African and international copyright laws.
- You may not copy, reproduce, modify, or distribute any content from this website without prior written consent from Emstel Art & Framing.
3. Trademarks
- The Emstel Art & Framing and Gallery Direct names and logos are registered trademarks of Emstel Art & Framing Pty Ltd. You may not use them without prior written consent.
4. Orders & Payments
- All orders are subject to acceptance by Emstel Art & Framing. We reserve the right to decline or cancel any order.
- Payment must be made in full before products are shipped.
- In the event of non-availability of a product, we will notify you and issue a refund or assist in finding a suitable alternative.
5. Shipping & Delivery
- Delivery timeframe: 7-10 working days for national orders.
- Packaging: All Products are boxed with protective packaging to ensure that your goods arrive safely.
- Shipping costs will be calculated at online check out based on the customer’s location.
- Responsibility: Emstel Art & Framing is responsible for all products until they are delivered to the address provided. Once delivered, responsibility passes to the customer.
6. Returns & Cancellations
- Damaged Items: Notify us within 24 hours of receiving your order, providing photographs of the packaging and item. After review, we will arrange a replacement or refund as per the Consumer Protection Act (CPA).
- Condition & Returns: All returns must be in original packaging and condition. Refunds will be processed once goods have been returned and assessed.
- Cancellations: Orders may be cancelled within 24 hours of purchase. After this time, cancellations cannot be accepted if the product is already in production or transit.
- Non-Returnable Items: Custom or personalised products cannot be returned unless defective or damaged upon arrival, in line with the CPA.
7. Privacy
- Emstel Art & Framing respects your privacy. Please see our Privacy Policy for details on how we collect, use, and protect your personal information in accordance with the Protection of Personal Information Act (POPIA).
8. Site Usage
You agree not to use this website in any way that:
- Interrupts or interferes with its functionality.
- Uploads or transmits malicious software or harmful code.
- Violates applicable laws or regulations.
9. Liability
- Emstel Art & Framing will take all reasonable steps to ensure that artworks are delivered safely and on time.
- We are not responsible for delays caused by third-party couriers, customs clearance, or force majeure events (e.g., strikes, natural disasters, pandemics).
- To the fullest extent permitted by law, Emstel Art & Framing shall not be liable for any indirect or consequential loss related to the use of our website or products.
10. Governing Law
These Terms & Conditions are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of South African courts.
